Terms of Service (Electronic Services)

These Terms of Service govern the provision of electronic services by the Listownia website, in accordance with the Polish Act of 18 July 2002 on the Provision of Electronic Services and — with respect to consumer contracts — the Polish Act of 30 May 2014 on Consumer Rights.

§ 1. Definitions

  • Service — the Listownia website, available at listownia.pl.
  • Service Provider — SavvyLed Sp. z o.o., with its registered office at Złota 61/100, 00-819 Warszawa, KRS 0000499181, NIP 5272709910, REGON 147122290.
  • User — a natural person using the Service in their own administrative case (applicant); to the extent covered by consumer protection law — a consumer.
  • Service (electronic) — preparation of a draft administrative letter (together with dispatch instructions) based on data provided by the User.
  • Document — the draft letter in PDF format, together with dispatch instructions, generated by the Service.
  • Account — the optional, voluntary collection of User resources within the Service.

§ 2. General provisions

  1. The Service Provider delivers, via the Service, electronic services consisting of preparing draft administrative letters for foreigners conducting residence and citizenship cases before voivodeship offices.
  2. The Service Provider can be contacted by email at info@listownia.pl.
  3. Use of the Service constitutes acceptance of these Terms of Service.

§ 3. Nature of the service (key provisions)

  1. The Service is a tool for independent preparation of a draft letter ("letter generator", "document templates", language and organisational assistance).
  2. The Service is not a law firm; it does not provide legal assistance or legal advice; it is not a solicitor or legal counsel; and it does not represent the User.
  3. The Document is a draft requiring independent verification by the User before it is used or sent. The User bears sole responsibility for the content, completeness and dispatch of the letter.
  4. The Service Provider does not guarantee the achievement of any outcome in the User's case, in particular a positive decision or an acceleration of the proceedings.
  5. The Service prepares the letter together with dispatch instructions; it does not send the letter on behalf of the User and does not transmit the User's data to any authority — dispatch (e.g. via e-Doręczenia) is carried out by the User independently.
  6. Only a User acting in their own case may use the Service; in the current version the Service does not support attorneys, representatives or representation of other persons or entities.

§ 4. Technical requirements and Account

  1. Use of the Service requires a device with internet access and an up-to-date browser, as well as an active email address.
  2. Creating an Account is voluntary — the Service can be used in full without an Account. The rules for processing Account data are set out in the Privacy Policy.

§ 5. Rules of use

  1. The User undertakes to provide accurate and complete data and to use the Service in accordance with the law and these Terms of Service.
  2. Providing unlawful content is prohibited.
  3. The User independently verifies the generated Document before using it.

§ 6. Prices and payments

  1. Document generation is a paid service. Prices are displayed in the Service before payment is made, are gross prices (inclusive of VAT) and are expressed in Polish złoty (PLN).
  2. Payments are processed via the Przelewy24 service. The payment-card operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS 0000347935, NIP 7792369887, REGON 301345068. The Service Provider does not store payment card data. Detailed payment rules are set out in the Przelewy24 service regulations, available at https://www.przelewy24.pl/regulamin.
  3. The contract for the supply of digital content is concluded at the moment of successful completion of the payment.
  4. After payment is made, the Service Provider issues an invoice, which is sent to the User's email address together with the generated Document and the dispatch instructions.

§ 7. Service delivery

  1. Upon payment confirmation, the Service immediately generates the Document and makes it available to the User for download (and, if requested, sends a link to the provided email address).
  2. The Document is available for download for the period indicated in the Service; once the retention period expires (see Privacy Policy) it is automatically deleted.

§ 8. Right of withdrawal and its exclusion

  1. As a general rule, a Consumer has the right to withdraw from a distance contract within 14 days without giving any reason (Art. 27 of the Consumer Rights Act).
  2. The right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the Consumer's prior express consent and the Consumer has been informed that they will thereby lose their right of withdrawal, and has acknowledged this (Art. 38(13) of the Consumer Rights Act).
  3. By placing an order, the User:
    1. gives express consent to the commencement of performance (generation of the Document) immediately after payment, before the expiry of the withdrawal period; and
    2. acknowledges that upon generation of the Document they will lose the right of withdrawal.

    The above acknowledgement is collected in the Service by a separate declaration before payment.

§ 9. Complaints

  1. The User may submit a complaint regarding the Service to the email address info@listownia.pl, describing their objections.
  2. The Service Provider considers the complaint within 14 days of receipt and informs the User of the outcome at the provided email address.
  3. If the complaint is upheld, the Service Provider may in particular regenerate the Document or issue a refund. The refund is credited to the account from which payment was made.

§ 10. Liability

  1. The Service Provider supplies a tool for preparing a draft letter; the Document requires independent verification by the User (§ 3).
  2. The Service Provider is not liable for the consequences of the User's use of the Document, including the outcome or course of administrative proceedings, or for the accuracy and completeness of data provided by the User.
  3. The provisions of this section do not exclude or limit the rights of the Consumer arising from mandatory provisions of law.
  4. The Document is a draft prepared on the basis of data provided by the User and requires independent verification; the Service Provider recommends consulting a lawyer before using the Document. The User bears responsibility for the decision to use the Document — including the decision to use it without legal consultation — and for the consequences, including legal consequences, of such use in their own case. The Service Provider is not liable for the outcome or course of the User's administrative proceedings.

§ 11. Personal data

The rules for processing personal data are set out in the Privacy Policy. Use of the Service involves the processing of data in accordance with the rules described therein.

§ 12. Intellectual property

  1. The Service, its elements and letter templates are protected by law.
  2. The User may use the generated Document for the purposes of their own case.

§ 13. Final provisions

  1. The Service Provider may amend these Terms of Service for important reasons, in particular: changes in law or legal requirements, the development or improvement of services and features of the Service, security reasons, and technical or organisational changes. Users will be notified via the Service, and Account holders will additionally be notified by email. Contracts concluded before an amendment are governed by the Terms of Service as in force at the time of conclusion.
  2. Matters not regulated herein are governed by Polish law. Any disputes shall be resolved by the court having general jurisdiction under applicable procedural rules.
  3. The Consumer may use out-of-court means of resolving complaints and pursuing claims, in particular the assistance of the district (municipal) consumer ombudsman (rzecznik konsumentów).
