Ponaglenie — when and how to file it (and when to wait)

A ponaglenie is a formal letter filed with the supervisory authority when the office has exceeded the statutory deadline for processing your case. Filed too early it may be rejected — find out when the right moment is.

When and how to file a ponaglenie — conditions, addressee, and effect

A ponaglenie is a legal remedy provided for in Article 37 of the Code of Administrative Procedure (k.p.a.). It is available to a party to the proceedings when the administrative authority has not resolved the case within the statutory or self-imposed deadline, or when the proceedings are taking longer than is necessary to establish the facts required for a decision.

The key question of timing: a ponaglenie may only be filed after the deadline set by k.p.a. has elapsed — typically one month or two months from the date proceedings were opened, or after the expiry of a new deadline set by the office itself. Filing a ponaglenie before the deadline has passed will be treated as premature and rejected. Before filing, check carefully when the office accepted your application and how much time has elapsed.

Who do you address a ponaglenie to? You address it to the supervisory authority above the authority handling your case, but via (through) the office handling your case — for example through the voivodeship office, which then forwards it to the Head of the Office for Foreigners (UdSC). The supervisory authority examines whether there has been a breach of deadlines and may set a new deadline for the lower-level authority and order it to progress the case.

What does a ponaglenie achieve? The supervisory authority determines whether inactivity or undue prolongation of proceedings has occurred. It then requires the office to set a new deadline and to inform the party of the steps taken. A ponaglenie does not guarantee a faster decision or a positive outcome — it is a disciplinary measure directed at the office, not a mechanism that influences the substantive outcome of the case.

Important note: a ponaglenie concerns only inactivity or undue prolongation of administrative proceedings. If you have objections to the content of a decision, the appropriate remedy is an appeal (odwołanie), and subsequently a complaint to the administrative court (WSA) — these remedies are outside the scope of Listownia.
